Nexstar Files Lawsuit Against Former KNWA Sports Anchor
Arkansas Business.com is reporting Nexstar, parent company of KNWA and KARK, has filed a lawsuit to keep former sports anchor Bo Mattingly off the radio airwaves. Below is an excerpt from the article:
"Mattingly and Cumulus Broadcasting LLC were named Friday in a lawsuit filed by Nexstar claiming that the broadcaster was violating a noncompete agreement. The lawsuit also said Mattingly and was in breach of his contract with the company by launching a sports talk show this week less, than one month after he resigned from his television post. Nexstar also filed a preliminary injunction to keep the show off the air.
"I'm going to do my job and let my attorneys do theirs," Mattingly said. "For me it's going to be business as usual."

It will be interesting to see how this turns out. Does anyone remember the details of KHBS vs. Steve Gibbs when he went to KPOM (now KNWA)? Was there a lawsuit? I simply can't remember....
steve gibbs' contract expired and both parties agreed to not renew. bo walked off his contract.
The last thing Deathstar needs to do is waste money on a lawsuit....

I may be wrong, but I think since Arkansas is a right to work state they can't stop him from working for the competition.
The public should file a lawsuit against KATV to keep Beau McCastlain off the air.
knwa gave bo his life back, no one wanted him after the dwis. wasn't he doing like a couple hours on the x radio station before? come on! you should be able to trust people. if you say you will work for a station for a period of time, you should work for them for that period of time. he did not keep his word. you should be held accountable. i bet they paid him every two weeks like they said they would.
right to work state? then why have a contract at all? i'd have to say Bo signed a contract saying he only had the right to work for knwa and not their competitors. last time i checked, a signed contract is a legally binding agreement, and Bo has failed to live up to his end of the deal. i don't see where his ego will get him out of this one, and the trend of Bo being a loser will continue.
In the Steve Gibbs' case there was a lawsuit. He had a no compete.
The judge toss the lawsuit because you can't keep a person from working.
These contract are not worth the paper they are written on.
Does KNWA want Bo back?
Guess that means the long standing relationship between cumulus and KNWA has ended. I can't imagine them helping each other anymore. Way to go KNWA when the radio stations have more listeners than you have viewers. If Bo was going to leave anyway, at least you could let him go and try to stay businesslike about the entire thing. Just another stupid thing KNWA's half-ass management has done to alienate the market and the community. Sook needs to clean house before his idiot underlings run him out of business in NWA.
with steve gibbs, the contract had expired so the lawsuit was based on the no compete for a year after it expired. bo walked out of his contract, it was not over. so, the lawsuits are not the same. i think people should keep ther word. he is obviously not the rightious man he claims to be. he's just a liar.

I think it is less about money and more about bo trying to screw the station over.
Bo turned KNWA's sports department around in a matter of months. It used to be horrible and it quickly became the best in the state after he took over.
I know some people don't like Bo but he is the reason KNWA jumped so high in the ratings and I believe he should be able to leave whenever he wants. Especially, since management can fire anyone whenever they want.
It's only fair and its not like he is working for another station. He has a radio talkshow for crying out loud. That has nothing to do with KNWA's product

Ratings are a manuiplation of numbers, example: OH LOOK!! WE PULLED A 9/18 IN THE 20 to 40 DEMOS.
Ratings are used for sales department, so this is why I call BULL!
I call bull on the bull writer. Say what you want about KNWA's product but their sports coverage of the Hogs is far ahead of any in the state. Now whether that was Bo or it was the resources of money and bodies that Nexstar threw at sports is the question.

This guy must have been pretty good if they don't want him competing. Plus, it's not even in the same market, is it? Yep, he's a pretty good draw if he warrants that much attention.
No-compete's are worthless. Their ONLY purpose is to intimidate anchors/reporters from jumping ship to another station in the market. If challeneged, they fold like a cheap card table. Always have, always will.
God knows what Nexstar's doing, but it isn't smart.

He signed a contract. Nobody forced him to do so. Once signed, the contract is a binding legal document. If he wanted to be able to leave the job whenever he wanted to, he should have found a job at the station that didn't require a contract.
Management CANNOT just fire anyone whenever they want. Yes, they can fire for cause or lay people off, but just "firing whenever they want" is just as much of a breach of contract.

I hope you guys aren't still in a job you hate because of a contract/non-compete. You really should look at the law. Any employer can fire an employee without cause, despite anything a contract may or may not say, it is the law. Any employee may terminate their employment with an employer without cause, it is the law.
You cannot write a legal contract that contradicts the law... Good job hunting!

Nice topic. I looked back at past topics where the GM at each of the Arkansas stations have been slammed by their employees. My questions would be how would you rate your GM compared to the others in the state? Who is the best at support,their word,and motivation? These are just suggested questions. Please feel free to add to list. This could get interesting. Let the blogging begin!!!

One important question about the M.B. matter. Who the Hell cares? Both parties involved in WHATEVER it was that allegedly happened are adults, which is more than I can say for those leaving cryptic postings. Why does anyone who was not directly involved care? Back to the subject at hand. Bo's gone. KNWA will suffer, so they want him to suffer, too. Will they gain anything? Probably not, but they'll make him sweat it a little, and that is what they're going for. They wouldn't want him back at this point, he's lost credibility.
