National News Organizations Challege Ban On Drones

Well this story is hitting home as with all the talk about KATV photographer Brian Emfinger's of a drone to get footage of tornado devastation in central Arkansas last week.  At least a dozen national news organizations have filed a brief with the FAA challenging the decision to ban the use of drones by commercial news gatherers.

"The FAA's position is untenable as it rests on a fundamental misunderstanding about journalism. News gathering is not a 'business purpose.' It is a First Amendment right," the brief said.

The FAA said in a statement late Tuesday it was concerned that the NTSB judge's decision "could impact the safe operation of the national airspace system and the safety of people and property on the ground."

What I wonder is, is Brian Emfinger "off the clock" when he is operating his news gathering drone.  If he is acting as a freelancer that maybe within being legal BUT if he is on the clock and wearing his KATV hat he could be in HOT water.  Is he selling the video to KATV?  Does he give the other stations equal opportunity to "purchase" the video...or does he give KATV the exclusive?...Just some questions to think about.

And then comes this story today of a drone with a camera slamming into a skyscaper in St Louis.

Katv plays by its own rules anyway. They think they are all high and mighty.

They are the All Mighty.

All mighty? Whatever. KATV's stories are starting to look as bad as THV's. That one about the heart surgery tonight was hard to watch. Did Emfinger do that one? If so, he should stick to his drone video. Jump cuts all over it.

I doubt Brian had anything to do with cutting that, but all of our sweeps packages have been weak editing-wise this book.

At 10:04 AM, May 14, 2014, Anonymous Anonymous said...

It's because we keep hiring "editors" who have no interest in being an editor. Surprise, surprise - they aren't very good at it! And MK cut the piece your talking about. He doesn't understand what a jump cut is.

At 12:29 PM, May 14, 2014, Anonymous Anonymous said...

Let me get this straight. Regular editors cut KATV's packages? I think your problem is staring you right in the face.

At 2:07 PM, May 14, 2014, Anonymous Anonymous said...

those editors will soon be a thing of the past at KATV. Hello sinclair!

At 2:13 PM, May 14, 2014, Anonymous Anonymous said...

Nick Genty praised the editors in mass emails but their salaries were in the low 20's. The best editors who could do tricks like professionals at a production company all left since last sweeps. This round of sweeps are struggling. Plus, we are not hiring more photogs so the editors have to shoot at any given time and they have to leave a project and sometimes have to let someone else pick it up.

At 2:18 PM, May 14, 2014, Anonymous Anonymous said...

Well of course! Nevermind Sinclair making it happen - Why would you want anyone but a seasoned photographer who was there working on the story with you to cut it?

At 2:41 PM, May 14, 2014, Anonymous Anonymous said...

That sounds like a messed up way of doing things all around. Photogs always should cut their stories. With a photographer, you can discuss in the field how you are going to set it up, transition shots, who you are focusing on, ect. How in the world do you do that with an editor at the station? It surpises me that Genty would allow this to go on, since he was once a decent photog himself. Or was this his idea to begin with?

At 4:22 PM, May 14, 2014, Anonymous Anonymous said...

KATV is live shot crazy. Even if a photog has time to edit, they use the excuse that they have a live shot and they will purposely leave 2 hours early to set up down the street. It has been that way since before Nick but he hasn't taken initiative to make changes or demand the photog positions not disappear.

At 4:52 PM, May 14, 2014, Anonymous Anonymous said...

Whatever the reasons, it doesn't look like it's working. I doubt this will affect their ratings much though. It's just a product quality thing that viewers probably won't notice right away. I feel sorry for the reporters trying to get a good reel together.

At 5:13 PM, May 14, 2014, Anonymous Anonymous said...

A live shot excuse? Doesn't the desk tell them where and when to go? Either the desk doesn't care or that is complete BS.

At 5:52 PM, May 14, 2014, Anonymous Anonymous said...

It is true. No one tells photographers to edit. If Angela, AKA the desk, calls one of them at 3 in the afternoon to go shoot something, it is not uncommon for the photog to say they are already in the live truck and to call someone else. We need better photographers. Chato, Brian and Mac work harder than all the others.

At 6:33 PM, May 14, 2014, Anonymous Anonymous said...

If that's true then Angela sounds like part of the problem.

Please get Angela help!

At 7:13 PM, May 14, 2014, Anonymous Anonymous said...

Well now we are talking about the real problems! I like this better than most threads.

At 7:50 PM, May 14, 2014, Anonymous Anonymous said...

Why should anyone have to tell a photographer to edit his story? That is nuts. Maybe I should just start telling producers to write my package for me. After all, I have to front it on a live shot right?

At 10:26 PM, May 14, 2014, Anonymous Anonymous said...

Ok I made a point to watch the sweeps package that KATV promoted all day, and yes that was bad. So many opportunities for nats, music, ect... and all wasted.

At 10:55 PM, May 14, 2014, Anonymous Anonymous said...

Does Brian Emfinger even know how to edit? He rather fly his drone than get in an edit bay.

I was just thinking the other day how we should do another creative lipdub video or something, but the truth is we no longer have anyone talented enough to pull it off. Sad. We used to have such creative editors. Even sadder that we never have had creative or motivated photogs.

At 9:18 AM, May 15, 2014, Anonymous Anonymous said...

That's true. Anyone talented enough to do those things is gone. Why can't we find good ones anymore?

If reporters are so concerned that their stories aren't being shot how they want, they are always welcome to pick up a camera

Yeah that's a good idea. Get smart with us. It's not like people keep leaving, right? Right? ?

At 3:23 PM, May 15, 2014, Anonymous Anonymous said...

I don't work at 7. I'm just saying if it affects your future, do something about it. If editors aren't editing packages how photogs want, then photogs need to find a way to do the live shot and edit (ex: field edit), if reporters don't like the way photogs do something offer to MMJ, I could go down the line but you get my point.

At 3:37 PM, May 15, 2014, Anonymous Anonymous said...

I think you miss the point. The point is photogs couldn't give two figs how packages are edited. They take no responsibility for anything they do. Live shots are used as excuses and hiding places. Reporters didn't sign up to MMJ. Editors get pooped on, and the packages look terrible. That's the problem.

At 3:43 PM, May 15, 2014, Anonymous Anonymous said...

Then you have complacent photogs and management. When do your reporters have packages ready to be edited by? Photogs/editors should have at least an hour to edit if you want it good. I've seen reporters give photogs/editors scripts 30 minutes before a show. You can't expect a photog to cut a package and set up a live shot in the that time.

Don't get me wrong I'm all for photogs editing their own stuff, but sometimes you don't have a choice

At 4:17 PM, May 15, 2014, Anonymous Anonymous said...

We all agree with your first sentence. There is no real deadline for reporters to get it to the editors.

At 5:35 PM, May 15, 2014, Anonymous Anonymous said...

I also don't see what "Angela" needs help with. Remember who shot packages, schedule them to edit their packs, schedule photogs that shot the vosots to do live shots - assignment desk 101. What's hard about that?

Angela Rachel IS the assignment desk, that is a problem. All other stations have a day and an evening shift desk person or two. They might even have someone on the desk overnight. Not KATV.

I had a better assignment editor in my last 100's market. She misses things constantly, sends photographers to stories that aren't actually happening, and draws pictures during important meetings.

At 7:46 AM, May 19, 2014, Anonymous Anonymous said...

5:44 got it correct. It's the same reason we don't get mad at Ray - she is just too stupid to do the job.

At 9:06 AM, May 19, 2014, Anonymous Anonymous said...

What is Angela's background? It could be that she just doesn't understand the news business very well. But from what I'm seeing, she is definitely the problem. Managerial skills are very important to that job, and it seems like she doesn't have a grasp on that part of it.

At 9:28 AM, May 19, 2014, Anonymous Anonymous said...

There is a serious lack of managerial skills at 7. From the top on down.

When I heard Kenny Reynolds got a job at katv several years ago, I thought he would be helping with desk duties. What does he do there? I never see him out on assignment.

An assistant news director on assignment? Are you nuts?

At 3:09 PM, May 19, 2014, Anonymous Anonymous said...

I think what 12:01 means, he isn't on the street and if she is the only person with that title, what is his responsibility?

At 4:55 PM, May 19, 2014, Anonymous Anonymous said...

Don't start in on people that you do not know. If any of you knew Angela you would know she works her tail off to get things done. I have no idea how many job duties she has but I can guarantee it is more than any other person in the newsroom. That probably goes for other stations as well when it comes to assignment editors.

It is the toughest job in the newsroom. People who are tough enough to take it usually find a reason to get away from it over time. Constant phone calls from viewers since KATV has no receptionist, dealing with photographers who sometimes act like they could care less about their job they only worry about their lunch, reporters begging for photographers that you don't have, setting up every satellite shot, corresponding with other affiliates and news organizations. Oh Yeah and planning everything for the next day. Yes, reporters do come in with story ideas, but those that work in the business know that those pan out on a 30% basis. Without a good assignment editor than shit would hit the fan and based on KATV's ratings over the years she has been there I would say she has done a fine job.

I could go on and on. Until you have been behind the desk then you can't say anything about it. I have been there but luckily I got the hell out of the business after some years. There are other things to do besides busting your hump for little pay.

At 9:38 PM, May 19, 2014, Anonymous Anonymous said...

So now 7 is strong because of the assignment desk? Come on.

At 3:09 AM, May 20, 2014, Anonymous Anonymous said...

No one said Angela didn't try, it's just that she's too stupid to do it. She also has bad habits from Alan Faulkner.

At 3:31 AM, May 20, 2014, Anonymous Anonymous said...

She doesn't understand how to manage photographers. That is the problem we are talking about. They do whatever they want and she is oblivious. None of them edit their stories and the wrong ones get assigned to live shots. For some reason she doesn't understand why that is not okay. No one forced Angela to take the job.

At 7:11 AM, May 20, 2014, Anonymous Anonymous said...

Stop complaining. If you think you can do better than do it. I am sure nobody would mind if someone on staff wanted to jump up there and help out.

As far as bad habits by Alan Faulkner, that would only consist of working yourself to the bone and allowing the news business to suck every ounce of life out of you before you realize that there is more to life. Faulkner ran KATV for years without ever taking credit.

The only reason someone would be negative about Alan would be because they never worked for him or just do not like him on a personal level, but I can guarantee the majority that worked for him or with him would have nothing negative to say.

At 7:39 AM, May 20, 2014, Anonymous Anonymous said...

It's not complaining to expect her to do her job

At 8:25 AM, May 20, 2014, Anonymous Anonymous said...

If I need someone to draw a cat I'll look around for Angela. Otherwise she's worthless.

At 8:44 AM, May 20, 2014, Anonymous Anonymous said...

If there is breaking news at 4:30, she assigns a photog to it and leaves at her usual time. Didn't get that from Faulkner.

At 8:54 AM, May 20, 2014, Anonymous Anonymous said...

She is a problem, but she's not THE problem. The problem is stories have turned out poorly and no one from management, including her, seems to care.

At 9:42 AM, May 20, 2014, Anonymous Anonymous said...

@8:44, if there's breaking news at 4:30, then she saw it on someone else's Twitter feed, because she definitely didn't hear it.
