KTHV, Gannett Sued for Discrimination

KTHV Sports anchor Mark Edwards has sued the station and its parent company for discrimination.  In a nutshell Edwards states KTHV and Gannett Corp. stood in his way of getting employment elsewhere and not promoting him further up the ladder at Channel 11.  A full brief of the lawsuit can be found HERE.  It is rumored Edwards is  no longer at Channel 11 as his bio is no longer on the station's website.  Edwards is seeking class certification, restitution, and compensatory and punitive damages for Civil Rights Act violations, loss of prospective earnings and a court order "to enjoin the discriminatory practices."

Spent a week in LR last year and watched THV quite a bit during that time.

At my peak, I was a sports anchor in an NFL city and was pretty damn good at it.

He was one of the worst sports anchors I've ever watched in a Top 100 market. Ever. Came off as unprepared, unenthusiastic and didn't seem to have much ambition in his sportscasts.

This lawsuit was filed either in the fourth quarter of 2013 or the first quarter of 2014. We are now in the second quarter of 2014, so I am sure that by him still continuing to work there up until now, it somewhat made things awkward.

Was his employment terminated because of the lawsuit he filed, or was his contract not renewed and thus the reason for him filing a lawsuit? As a lawyer by trade, I tend to look at not components, but the whole Picture and then process the information into a more analytical, fact-based, and comprehensive synopsis.

I do however find it interesting that immediately following Mark filing the lawsuit, THV decided to hire their very first African American prime (evening) anchor. With that being said, it leaves me to wonder if that was circumstantial or with forethought and premeditated to contest the allegations in the lawsuit.

It will be interesting to see how this will play out. I am pretty sure that THV had developed a well thought out plan when they originally hired Matt Turner last year, but due to his untimely demise it somewhat threw a wrench into their plans which I believe included some restructuring of roles and positions.

I personally think that Mark was a fine sports anchor; he seemed knowledgeable, articulated well, and the tone and quality of his voice was well suited for a sports anchor. I believe he was under contract, so basically, if THV chose not to renew it, there is little you can do about it unless there was discrimination involved, and without concrete evidence, discrimination is difficult to prove. On another hand, if THV purposefully or even inadvertently gave a bad reference to another potential employer that prevents him from gaining employment, or defamatory, that can be a serious problem for THV unless the negative reference can be substantiated with written documentation that has been put into his personnel file.

I will be watching to see how this concludes, as I stated earlier it should be interesting. I wish Mark the best in his future endeavors both personally and professionally!

THV has a history of not promoting people of African American decent, but it appears to be getting better and they appear to be more accepting of people with African American decent with adding Alyse a few years back as a morning anchor, and the recent hire of Denise Middleton. They have also hired a few reporters of African American decent.

In the past however, diversity was a problem. TJ Holmes could never advance further than weekend anchor at THV. THV felt he didn't have enough experience to be a weekday anchor, but that ended up being a blessing for him because he left THV and became a evening anchor in a top market at a NBC affiliate in San Francisco, then to CNN, and now MSNBC anchoring, and is reported to be in talks to co-anchor segments of The Today Show. So basically, he wasn't good enough for AR or THV, but good enough to go national.

I'm not comparing the Mark Edward situation to the TJ Holmes situation, but it definitely shows a pattern of not promoting qualified people of African American decent.

1:21, your comment is ludicrous and sad. TJ was named weekend anchor quickly and ahead of several reporters who had been on staff for much longer. There was no main anchor opening between the time he received that position and the time he left that he could have been offered. TJ found an opportunity and took it, there was no "blessing in disguise", it was always the plan.

He was young talented, driven, and THV rewarded that by giving him the weekend job in short order. What do you suppose they could have done? Kicked Andy Pearson or BJ Sams out of their chairs while they still had contracts? Nevermind, you probably are too young and dumb to even know who those two were.

I just love TJ Holmes, and I'm a little biased because we went to UA together. Last week he was a guest co-host on The View with Barbara Walters and a few weeks back he was a fill-in anchor on the NBC weekend evening news. So proud of him!

I ran into TJ in NYC at laguardia of all places. He's living in NYC now. I'm proud of him too. Just goes to prove that anything is possible if you work hard and set goals for yourself. It was never TJ's goal to remain in AR, he only planned on being in AR two years and then going to a larger market, and he done just that and much more.

If you google lawsuits against Gannett, you will see that they are no stranger to being sued. What Ch. 11 did to Mark is really is unfair on so many levels. These media companies have a million lawsuits filed against them because they get rid of people when they are up in age and hire younger people for less money. They get rid of people if they become disabled. Not many of the employees ever succeed because Gannett has corporate attorneys who used to discrimination & employees being treated like crap. But, the good thing is, I do think Mark will get another job because he is very professional & employable. I wish him the best. I hope he has a good lawyer that will who will do the right think & stand up for Mark. I think there are a number of politicians on the Republican side mainly that favor big business and the companies like the one Mark worked for. They think it is fine if people cant make a decent living.--look at all the Walmart type companies. I do believe this and it is all connected to the greed of the very wealthy in business who want people to work hard for as little as possible. I also think racism is rampant still. And they dont always like women either. Upper management is part of that structure and in the pocket of the board of directors much of the time. The General Manager does what he is told & if things turn out with another lawsuit, upper management blames the GM. Gannett doesn't seem to want real news reporters either. They want young kids who will do as they are told. Obviously, they hired Denise to cover their tracks. If Mark had not filed the lawsuit, Denise would not be in that position.

Denise has disappointed me. I had high hopes for her and still think she's beautiful. But her lackluster personality and delivery make her boring to watch. Dawn is the saving grace at 5:00. Mark was always middle of the road for me..........didn't love him and didn't dislike him. With what little info has been provided here I can't tell if he has a case. Sad deal all around.

While Mark may not have been the best on the air, I think he's a great guy. He called me many times wanting to improve. At one point he had offers in a couple of large markets but decided to stay for family.

And TJ Holmes may have done fine for himself, but he is a superficial,manipulative human being who has no problem leaving people who care for him on the side of the road if it means he can feed his needy self. In other words, a typical anchor no matter what the skin color.

I hate that TJ wasn't named Josh Elliott's replacement on GMA. It was rumored that he was in top running for it. I feel that GMA should have replaced Josh with another male, because they replaced Sam Champion with a female and now there are too many females. The only male is George. It's rumored that TJ is joining the Today Show though. If he does, I'll probably switch from GMA to the Today Show.

Just to check here. Did Mark start in LR? If so, he never had to hack his way through Jonesboro, Lawton, Greenville or some of the other first-job sports hell holes. Starting in Little Rock, on-air, is very rare. It's like being born on second base in TV sports.

Part of trying to get promoted is doing a superior job and talking with the bosses about a long-range future. Maybe he did this. Maybe not.

What I am curious about is, if this goes to trial, will KTHV break out reels of his sportscasts and point out the incompetence in open court?

Ask anyone who has been in TV sports. If you're not a white male, you can move up markets fast in sports.

If ME had offers in Cleveland and/or Phoenix and KTHV wasn't willing to make him the sports director, why not leave him leave? That presents the best of all worlds - get rid of someone not up for the main job with no severance and no future legal action.

No. These people aren't racist. The blacks are the ones that are racist. They automatically assume that when a white person gets a job, promotion, raise, etc. that it's because that person is white -- which is absurd. White people in the TV business have to work three times as hard as the blacks to get the same rewards. A black person with little to no experience gets a job in TV ten times more often than a white person with years of experience and proven work ethic. Mark is a prime example of blacks thinking they deserve everything handed to them -- while doing absolutely nothing to deserve it! He didn't get promoted, because he has horrible work ethic, no desire to better himself, not a team player, shows up late every day, etc... So... He calls the racism card -- wanting free money. Pathetic.

I know two people TJ ripped off and treated with no respect. One was his wife who helped support him as he climbed the ladder and the. Dumped. The other was his former agent who believed him and got him into the ladder.

I helped TJ on several occasions and never a thank you- always entitlement.

Perhaps he has changed. But envy shouldn't be confused for pointing out bad manners

As a Latino female I face racism and sexism. And truthfully, I'm freaking tired of hearing the white male complain about how hard they have it... blah, blah, blah! Walk a day in my shoes and you'll understand what racism is. THV doesn't even have one Latino anchor or reporter, so to me that's the real problem, at least African Americans have representation...we have none. In my opinion it's the white male that always playing the victim...get real! If you're a white male not moving up the ladder, it's probably because you suck! For a Latino, female or any minority to advance we have to be as twice as talented as the white male. White men can get away with mediocrity, not so for a female or minority.

Minorities have had a clear advantage in this business for quite a while now. Everyone in television news understands and accepts that fact. It's gotten to the point where professors in college are warning white kids to think twice about entering it, given discrimination they will face. I worked for two years as a reporter in ours nation's capital (Washington, DC) and another three years as a congressional communications liaison, before deciding to enter law school. Journalists do not "represent" you with our respective races. We are journalists and we cover all communities no matter what race we happen to be. Just as we would not flinch at having a Hispanic reporter cover an issue affecting a white community, white reporters can cover Hispanic community issues too. Stop seeing our races and worry more about the talent and character. You will feel better.

11:38, As Latino journalist we are very adaptable to a diversity of environments and we are also bilingual. Latinos are the largest minority group in the U.S., accounting for 15% of the population, African Americans account for 13%. Most white Americans are not bilingual, and therefore are not effective when covering issues in the Latino communities, and frankly, most Latinos don't trust white Americans so therefore even if they speak English, they will not feel comfortable communicating with you. My suggestion for white and black American journalist is to learn Spanish, because we aren't going anywhere. I for one was born in Puerto Rico and have been an American citizen since day one, and grew up speaking both Spanish & English, but Latinos from south of the border and elsewhere are often not bilingual. So no, I do not agree with you.

The majority of white Americans do not speak Spanish, and that's a fact. The fact is, a large percentage of Latinos in America, especially the South are first generation Mexicans, even though I'm not Mexican, I'm still a Spanish speaking Latino in which they can relate to. I hope that news directors and television stations will eventually come to realize the importance of hiring a competent and bilingual journalist. With a competent and bilingual journalist you simply get more bang for your buck....it's a good investment that pays dividends.

In regards to your comment at 11:11... We all (well, maybe not you or others with no sense of reality) know the only reason you got the job in D.C. is because of your ethinicity. You probably got that job over an extremely qualified white man OR woman -- who, also, may have been bilingual. While looking for new on-air talent, I have seen a Little Rock TV station all but throw out any tape/resumè received by a white woman/man; however, I've seen managers try, as hard, as they can, to persuade themselves and others to like a black candidate. These candidates were horrible... but because they were black, managers gave them every chance imaginable... while white candidates, practically, had no chance from the start. I've seen black, on-air talent excel, strive to be better, act as a team player, do their job without complaining, etc... and they get just as much respect from me, as would any white person with the same work ethic and skill set. BUT... to say any black, Hispanic, Indian, Asian, or whomever doesn't get complete priority over whites is foolish and shows your ignorance!

I am a Hispanic reporter that used to work in the Little Rock market. I think I have certainly been afforded opportunities that many of my white colleagues and friends did not receive because of my heritage. I don't feel bad about taking advantage of them, but I could see how denying they exist is a bit of insult to injury. There are some very talented white friends of mine who are waiting in the wings and hoping for anyone to take a chance on them. Please don't slap them in the face with this nonsense. For the most part they all accept it and understand the need for diversity. Let's try to keep it that way by not being sore winners.

Last I checked there wasn't one Latino anchor or reporter in the Little Rock market. The only Latino reporter I can ever recall THV ever having was the sweet Kat (Katharina) before she went to KATV. I do agree that KATV has been more inclusive of Latinos, but since Christina, Kat, and Jeannette have all recently left KATV we no longer have any representation and I feel that it's crucial that we receive the representation we deserve and I will continue to be an advocate of not only Latinos, but all disenfranchised and underrepresented populations.

Several years ago, THV11 didn't have many minorities.

It was nice when they had blacks, whites, a hispanic and 2 asians (Liz and Pam) (and I think Faith was actually African American). It is a great mix that represents the melting pot the state has become.

THV11 does have a lot of minorites right now, they are all black. I don't have a problem with that because sometimes you can look like you are trying too hard to get at something. (Like people saying Denise was only hired because she is black.)

KATV is going back to the all white blonde female anchors again. Maybe it is by accident.

I don't know if Jordan Bontke was too good to pass up but they should have looked for a minority knowing Jeannette and Katherina were leaving. Now you have Scott Inman tossing to all white reporters. Not to mention, when he is off, they have twins, Erin and Beth anchor together. I hear their audience is older so maybe that is fine with them.

Fox/KARK are about to lose two black male reporters who are both getting out of the business.

This is a place where people are anonymous and get to vent.

If someone comes on here and defends someone or himself, you attack that poster.

No one can leave a nice comment on here or they get attacked.

Everyone (that means you) has flaws or something to work on and that is what is picked on. Not the positives, which I am sure there are more positives about people than the negative. Yet you find the things to bully people about.

To say three hard working minority women all sucked is just mean. They left for jobs making triple what they were making at KATV. They are bettering their lives and it is because their hard work is paying off. They all had 'potential' and I hope what flaws you see, they will get better at places that will actually nurture them.

One time on the news program he was saying he had another child prior to the 2 he always showed or talked about re: their sport teams. So that would be 3 children. THis was back when Wes Moore was still on.

2 of those paternity suits were 1) 2012 birth and 2) 2013 birth.

Strange that for the child born in 2012, in 2013 the order says doesn't have to carry insur as it is NOT avail thru his employer. Hmm they don't have insurance at KTHV?

Last Oct they met him in parking lot to serve him for Paternity. How embarrassing that has to be. Playa didn't have his MIND on the game/job it appears, so now he wants to blame the station.

I'm not a sports fanatic but I did like watching THV until I couldn't stand to listen to Mark Edwards bumble thru the sports. Really liked everyone on there before and now but had to switch to one of the other news stations and even some of their reporters bumble thru the news too and it drives me crazy! And it's not just every now and then it's every time they are on. I often wonder if they are in dire need of news personalities and just decide to hire whoever has a college degree. There was one person on one of the channels that just showed up on a snowy weekday morning show and was reporting about the back up in traffic. I honestly thought it was a person they pulled out of traffic and asked to give their view on what was going on. Imagine my surprise when I started seeing them do more and more segments! I guess it's hard to find good quality people anymore.

Who's ignorant here? We can't call a sub par anchor sub par just because he's black? He was horrible, the only reason he got to where he is and stayed there for any length of time is because he's black. A white male reporter/anchor that had the same ability and speaking level as him wouldn't even have gotten a job let alone an anchor spot. And as much as it sucks it is fair to bring his personal life into it. When you are a public figure and you represent a station you do that 24 hours a day, not just when you are on air. There have been countless personalities fired all over the country for personal reasons. Most stations even require a morals or personal conduct clause in their contracts. I've worked at many stations, to be able to fire a black person you usually have to have numerous complaints and a paperwork file that would make an accountant blush. A white guy, no problem. That's what's racist around here. Hiring someone just because of he color of their skin is the definition of racism and it happens everyday.

As a Puerto Rican I am a beautiful blend of European Spainard, Taino Indian, and Black African; and I'm proud of each and every component of my DNA and ancestry. Growing up in such a diverse place as The Bronx, NY and going to undergrad and law school in the equally diverse Washington, DC and then moving to AR is total cultural shock. The media in Little Rock has always been very racist! They need to be served! Black talent has always been shafted in the past. There should be a more diverse talent pool on all of these television stations. Brittney Johnson is one of the best on the air currently and extremely polished and she still remains weekends and fill ins. She better than 90 percent of the other talent you see on our broadcast airwaves.

Now at the end of the day pertaining to Mark Edwards. If his claims are substantiated, then the climate in the local Arkansas media has to change. There are to many blacks in the four county metro not to have better representation on the airwaves! But, I still believe that it comes down to talent at the end of the day!

I don't know if Mark has a case against KTHV and Gannett or not but what I do know is that I always enjoyed watching Mark do the sports. He was fun, he was entertaining and I looked forward to his broadcasts.

Yes, there were many more things to report on beside the Razorbacks with a(very)few nods to other Arkansas teams but I don't see that as a "Mark Edwards" problem. I have noticed that on the other news stations as well when I have watched them. For some reason in this market sports reporting seems not to matter in the least. I wish that would change.

Going back to the issue of Mark Edwards, he is missed. He was fun and some of us really enjoyed his off beat comments like, "lookie, lookie, ice cream cookie."

I wish Mark the best and am sad that he is no longer on KTHV.

Oh, before anyone decides I am a "plant" or some such nonsense please know that I am just a fan who wishes we were still enjoying "Today's THV" the way things used to be instead of the cr*ppy cookie cutter that Gannett has created.

Regardless of what you would like to believe; racism is still happening in Arkansas. I am a african american woman that works in corporate America. Being qualified is a lie. I was told that the only thing I lacked was a degree. I have two and a masters,and have seen white males come in with a GED and get promoted. Every black male that has every worked with the company that I work dor has always been under payed and overworked. Before this lawsuit,I questioned the lack of diversity of the anchors on the news channels. This is crazy!

Sure a work place should be diverse but being able to do the best job..being the best person for the job should come first. His contract expires in a few wks and I'm sure you'll be back on here hating when it's announced where he'll be headed. The same ignorance when former THV sports anchor, Aiyana left here for Miami, and now the number 3 market, Chicago. Get a life!

I don't know if he has a good case but I do know that there is a lack of African-American presence in the Arkansas news media and it has been like that for years. As far as Mark Edwards is concerned, I am glad he is finally gone because he was a terrible sports anchor and an even worse human being. He is being portrayed as a good father when I know for a fact that he has at least 3 out of wedlock children that he barely supports and doesn't even claim. He continued to have extra-marital affairs while being portrayed as a good husband and father. As an African-American male myself, I consider him to be the worse kind of example of man who has no place in the public spotlight. I see all of this that is happening in his life now as being karma finally catching up to him.

I know Mark personally and I'm glad he's no longer on the air. He says he has emails of them promising him a promotion and raise. Then they told him the position was dissolved because it was no longer needed and he was never put on any posters or signs. That's why he suing. He wasn't appreciative of the position. All he did was complain about his coworkers. Past and present. He was goofy on the air. This he would say off air and post on social media are offensive . He's one big lie. His wife Lavinia finally filed for divorce a week or two ago because she was tired of being cheated on and lied to. He would repeatedly have his girlfriends visit him at the station . He has 4 children he claims publicaly. Jordan, JaKobe Marcus (whom he barely has a relationship with and just recently started talking to again), Justin and Jaylen. He acts like he only has 2 children. Jordan and Justin. He has only posted 1 pic of his daughter Jaylen. Besides those he has out of wedlock children he does not support. He has been cheating on Lavinia since they got together. He has unprotected sex with his flings which result in STDs and out of wedlock children. He prowled Henderson, UCA and UALR looking for young women to pursue. He is a terrible landlord because he barely fixes anything. Air conditioners going out in the summer time and tenants having to beg to have them replaced. He borrows money and does not repay it. He probably was not promoted because of his personal life. If you're on TV in some way you should be someone people can look up to and Mark Christopher Nelson in definitely not that. While he still speaks to TJ (usually to get ammo for his lawsuit) he is jealous of him and Aiyana because they were good enough to get out and he wasn't. He had an agent sending out tapes and he still wasn't getting any looks. He's a bad sportscaster and a sorry human being. He doesn't deserve the big payday he expecting to get from Gannet.

I do realize that there are some small-minded and under-educated people in AR, but I would hope you'd understand at a minimum basic and simple denotation. Last I checked, based on mtDNA (Mitochondrial DNA) I am 62% European, 18% sub-Suharan African, 14% Native American & 6% East Asian. If I was racist against whites, I would have to dislike 62% of my DNA; I'm also married to a Caucasian, and my two precious children are predominantly Caucasian too. So no, I am not a racist. I treat everyone fairly and couldn't care less what race someone is; I'm all about character. Thank you very much!
